This document outlines the terms and conditions governing the use of Pawradise Raw's services, website, and products. By accessing or using any part of the Pawradise Raw website or services, you agree to be bound by these terms.
I. Disclaimers and Liability:
• Veterinary Consultation: Pawradise Raw strongly recommends consulting your veterinarian before transitioning your pet to a commercially prepared, home-prepared cooked, or raw diet, especially if your pet has specific health needs. The company accepts no liability for any issues arising from the use of its products outside of established federal and state guidelines for safe handling and consumption.
• Order Placement and Pickup: Members are solely responsible for placing advance orders through the Pawradise Raw online store during designated periods for the products being ordered, and adhering to specified pickup requirements. This includes picking up orders at the designated location, date, and time. When prior delivery confirmation was provided, failure to pick up an order as scheduled, and within the allotted timeframe for the members selected location, results in the forfeiture of that order without refund or reimbursement.
• Order Verification: It is the member's responsibility to verify the accuracy of their order (weight, quantity, contents) and report any discrepancies on their invoice preferably before leaving the pickup location, but in no case, not more within 48 hours after the delivery.
• Risk Assumption: Participation in Pawradise Raw (including ordering and pickup) is undertaken at your own risk. You agree to defend, indemnify, and hold Pawradise Raw, its members, service providers, and suppliers harmless from any claims or expenses (including attorney’s fees) arising from your use of any product or service. Pawradise Raw is not responsible for misrepresentations made by suppliers.
• Sales and Returns: All sales are final. Perishable products (fresh or frozen) are non-returnable. The buyer assumes all risks associated with the use of these goods, whether used alone or in combination with other products. Pawradise Raw will not be held liable for any damage or injuries caused by the use of its products. Liability ceases upon delivery to the designated pickup location.
• Defective Products: Any defective product a member is seeking to return should be immediately reported to Pawradise Raw, with the specifics of the defect explained. All identifying information for the product, including Lot Numbers and “Best by Dates” for the defective product should also be reported. Final determination for the return and crediting a member for purported defective product will be made in conjunction with the products supplier.
II. Website and Email Communication:
• Website Malfunction and External Links: Pawradise Raw is not responsible for website malfunctions preventing access to goods or services. The website may contain links to external sites, which Pawradise Raw does not endorse nor control. Pawradise Raw is not responsible for the availability, content, or quality of these external sites and will not be held liable for any loss or damage resulting from their use.
• Purpose of Information: The Pawradise Raw website and associated emails serve as an informational resource for those interested in raw food for human or pet consumption. The provided information on nutrition and other pet issues is not evaluated by the FDA or AAFCO and represents the opinions of the authors, not official Pawradise Raw statements. Use the information at your own discretion.
• General Use: We provide general order and delivery information via email communications (including MailChimp emails). It is the members’ responsibility to read these email messages.
• Educational Use: The information is intended for educational purposes to assist in making informed decisions about health and nutrition. Statements made have not been evaluated by the FDA. Products are not intended to diagnose, treat, mitigate, cure, or prevent any disease.
• Prohibited Uses: You agree not to use Pawradise Raw's services for commercial purposes or any unlawful activity, including soliciting members for any purpose (including commercial or fundraising) or sending commercial emails. Sharing information from restricted areas of the website with non-members (via email, social media, etc.) is strictly prohibited.
III. Pawradise Raw Release of Liability and Site Rules:
• Liability Release: You agree to defend, indemnify, and hold harmless Pawradise Raw, its members, service providers, and suppliers from all claims and expenses arising from your use of any product or service.
• Site Responsibility: Your participation at any site (business, residence, cold storage, etc.) is at your own risk. Adults must always supervise children and animals. Additional site-specific rules will be provided at each pickup location.
IV. Pawradise Raw Member Code of Conduct:
• Order Placement and Pickup: Members must place orders through the Pawradise Raw website during designated periods. Orders must be confirmed at least 48 hours before pickup. Pickup must occur at the designated time and location. Failure to comply may lead to membership suspension or termination.
• Payment: Payments are generally due at the time the order is placed. For any order invoices due after the purchase date, members are responsible for managing all invoices and keeping all invoice payments current. Invoices must be paid within 7 days, or the specified due date on the invoice.
• Non-Compliance: Failure to pick up orders as scheduled more than once per year, or more than one time every four orders; or failure to pay outstanding balances within 7 days may result in indefinite membership suspension.
V. Online Store Terms:
• Age of Majority: By using the site, you represent that you are of legal age in your jurisdiction or have parental consent for any minor dependents to use it.
• Lawful Use: You may not use Pawradise Raw services for unlawful or unauthorized purposes, including copyright infringement. Any breach of terms will result in immediate service termination.
• Service Refusal: Pawradise Raw reserves the right to refuse service to anyone for any reason.
• Content Transfer and Encryption: Content (excluding credit card information) may be transferred unencrypted. Credit card information is always encrypted.
VI. Accuracy of Information:
• Pawradise Raw does not guarantee that website information is accurate, complete, or current. Use the information at your own risk.
• Historical information is provided for reference only. Pawradise Raw reserves the right to modify the website without notice. Members are responsible for monitoring changes.

VII. Products and Services:
• Products and services are available only by purchasing them online.
• Quantities for some products are limited, which may result in an order being delayed or cancelled.
• Pawradise Raw may refuse, limit, or cancel orders at its discretion. Notification will be attempted via email and/or phone.
• Pawradise Raw attempts to accurately depict product colors and images but cannot guarantee accuracy on all computer screens.
• Pawradise Raw reserves the right to limit sales to specific regions or individuals.
VIII. Billing and Account Information:

Arbitration Clause
• Any dispute, claim, or controversy arising out of or relating to this Agreement, or the breach, termination, or validity thereof, shall be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall take place in Arlington, Washington.
• The arbitration shall be conducted by a single arbitrator selected from the AAA panel and shall be governed by the Federal Arbitration Act and applicable Washington State laws. Both parties agree to share equally the costs of arbitration, and each party shall bear its own attorney's fees unless the arbitrator determines that a party has acted in bad faith.
• The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
XVIII. Entire Agreement:
• This document constitutes the entire agreement between Pawradise Raw and the user.
XIX. Changes to Terms:
• Pawradise Raw reserves the right to update these Terms at any time. Continued use of the website constitutes acceptance of any changes.
